1. Acceptance of Terms

By accessing or using the MyDataOverall platform ("Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. These terms apply to all users, including affiliates (publishers), advertisers, and visitors.

2. Account Registration

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

We reserve the right to approve, reject, or suspend any account at our sole discretion. Affiliate and advertiser accounts are subject to review and approval before activation.

3. Affiliate Terms

As an affiliate (publisher) on the Platform, you agree to:

  • Only promote offers through approved traffic sources and methods
  • Not engage in fraudulent, misleading, or deceptive practices
  • Not use cookie stuffing, adware, spyware, or any form of forced clicks
  • Not bid on advertiser brand keywords in paid search without explicit permission
  • Not generate leads through incentivized traffic unless explicitly approved
  • Comply with all applicable laws, including FTC disclosure requirements
  • Not misrepresent the products, services, or brands of advertisers

Violation of these terms may result in immediate account suspension, forfeiture of unpaid commissions, and permanent ban from the Platform.

4. Advertiser Terms

As an advertiser on the Platform, you agree to:

  • Provide accurate offer details, payout terms, and conversion criteria
  • Pay commissions for valid leads/conversions within the agreed payment terms
  • Not retroactively change payout terms for previously generated conversions
  • Provide timely feedback on lead quality and conversion status
  • Maintain accurate tracking and reporting on your end

5. Commissions and Payments

Commission rates are set on a per-offer basis and may vary by affiliate. Commissions are tracked through our platform and are subject to validation. We reserve the right to reverse or withhold commissions for fraudulent, invalid, or disputed conversions.

Payment schedules and minimum thresholds are communicated to each affiliate upon account approval. Late payments from advertisers may affect affiliate payment timelines.

6. Intellectual Property

All content, trademarks, and intellectual property on the Platform belong to MyDataOverall or its licensors. You may not copy, modify, distribute, or create derivative works of any Platform content without prior written consent.

7. Limitation of Liability

MyDataOverall provides the Platform "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount of commissions paid to you in the 12 months preceding the claim.

8. Termination

Either party may terminate the relationship at any time. Upon termination, pending valid commissions will be paid according to the regular payment schedule. We reserve the right to withhold payment for commissions under review or dispute at the time of termination.

9. Modifications

We may modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the modified terms.
